Qualifying for a TN Visa

TN visas were approved after the signing of the North American Free Trade Agreement (NAFTA) in 1994. The TN visa is a nonimmigrant visa, and it allows qualified professional workers from Mexico and Canada to work temporarily at established businesses in the United States.

A TN visa petition must meet the following conditions:

  • The applicant is a Mexican or Canadian citizen
  • The open position in the U.S. must be in the list of positions approved by NAFTA
  • The applicant meets the open position’s requirements
  • The applicant must work for a business domiciled in the United States and not be self-employed

Most positions on the approved list in NAFTA require a bachelor’s degree or its international equivalent. However, some positions only need a specific number of years of relevant work experience.
